Conveying person by water for hire in unsafe or overloaded vessel

Whoever knowingly or negligently conveys, or causes to be conveyed for hire, any person by water in any vessel, when that vessel is in such a state or so loaded as to endanger the life of that person, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to five thousand rupees, or with both.

Practical Note

This section targets operators of commercial boats or ferries who overload vessels or use unseaworthy vessels for passenger transport. The passenger must be carried 'for hire'. The prosecution must prove that the vessel was overloaded or unsafe and that the operator did so knowingly or negligently. The maximum fine is increased from ₹1,000 to ₹5,000 in the BNS. It is cognizable and bailable, triable by any Magistrate.

जो कोई, किसी व्यक्ति को किसी जलयान में जलमार्ग से जानते हुए या उपेक्षापूर्वक भाड़े पर तब ले जाता है, या ले जाने देता है, जब वह जलयान ऐसी दशा में हो या इतना लदा हुआ हो जिससे उस व्यक्ति का जीवन संकटापन्न हो सकता हो, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि छह मास तक की हो सकेगी, या जुर्माने से, जो पांच हजार रुपये तक का हो सकेगा, या दोनों से, दंडित किया जाएगा।
