1. Short title, commencement and application.
(1) This Act may be called the Bharatiya Nyaya Sanhita, 2023.
(2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different provisions of this Sanhita.
(3) Every person shall be liable to punishment under this Sanhita and not otherwise for every act or omission contrary to the provisions thereof, of which he shall be guilty within India.
(4) Any person liable, by any law for the time being in force in India, to be tried for an offence committed beyond India shall be dealt with according to the provisions of this Sanhita for any act committed beyond India in the same manner as if such act had been committed within India.
(5) The provisions of this Sanhita shall also apply to any offence committed by—
(a) any citizen of India in any place without and beyond India;
(b) any person on any ship or aircraft registered in India wherever it may be;
(c) any person in any place without and beyond India committing offence targeting a computer resource located in India.
Explanation.—In this section, the word “offence” includes every act committed outside India which, if committed in India, would be punishable under this Sanhita.
Illustration.
A, who is a citizen of India, commits a murder in any place without and beyond India. He can be tried and convicted of murder in any place in India in which he may be found.
(6) Nothing in this Sanhita shall affect the provisions of any Act for punishing mutiny and desertion of officers, soldiers, sailors or airmen in the service of the Government of India or the provisions of any special or local law.

1. संक्षिप्त नाम, प्रारंभ और लागू होना।
(1) इस अधिनियम का नाम भारतीय न्याय संहिता, 2023 होगा।
(2) यह उस तारीख को लागू होगा जिसे केंद्र सरकार, राजपत्र में अधिसूचना द्वारा, नियत करे, और इस संहिता के विभिन्न प्रावधानों के लिए अलग-अलग तारीखें नियत की जा सकती हैं।
(3) हर व्यक्ति इस संहिता के प्रावधानों के विपरीत किए गए हर ऐसे कार्य या लोप के लिए, जिसके लिए वह भारत के भीतर दोषी होगा, इस संहिता के अधीन दंड का भागी होगा, अन्यथा नहीं।
(4) कोई भी व्यक्ति जो भारत में लागू किसी कानून के अनुसार, भारत से बाहर किए गए किसी अपराध के लिए विचारण का भागी है, भारत से बाहर किए गए किसी भी कार्य के लिए इस संहिता के प्रावधानों के अनुसार उसी प्रकार निपटाया जाएगा मानो ऐसा कार्य भारत के भीतर किया गया हो।
(5) इस संहिता के प्रावधान निम्नलिखित द्वारा किए गए किसी भी अपराध पर भी लागू होंगे—
(a) भारत से बाहर और परे किसी भी स्थान पर भारत के किसी भी नागरिक द्वारा;
(b) भारत में पंजीकृत किसी भी जहाज या विमान पर किसी भी व्यक्ति द्वारा, चाहे वह कहीं भी हो;
(c) भारत से बाहर और परे किसी भी स्थान पर किसी भी व्यक्ति द्वारा भारत में स्थित कंप्यूटर संसाधन को लक्षित करके अपराध करना।
स्पष्टीकरण।—इस धारा में "अपराध" शब्द के अंतर्गत भारत से बाहर किया गया हर ऐसा कार्य आता है, जो यदि भारत में किया जाता, तो इस संहिता के अधीन दंडनीय होता।
दृष्टांत।
क, जो भारत का नागरिक है, भारत से बाहर और परे किसी भी स्थान पर हत्या करता है। उसका भारत के किसी भी स्थान पर जहाँ वह पाया जाए, हत्या के लिए विचारण और दोषसिद्धि की जा सकती है।
(6) इस संहिता की कोई भी बात भारत सरकार की सेवा में अधिकारियों, सैनिकों, नौसैनिकों या वायुसैनिकों द्वारा विद्रोह और मरुस्थल (भगोड़ापन) को दंडित करने वाले किसी भी अधिनियम के प्रावधानों या किसी विशेष या स्थानीय कानून के प्रावधानों को प्रभावित नहीं करेगी।
