Section 3 Limitation Act: Mandatory Dismissal

Subject to sections 4 to 24, every suit instituted, appeal preferred, and application made after the prescribed period shall be dismissed, even if limitation has not been set up as a defence by the respondent.

Section 4: Reopening Day Doctrine

Where the prescribed period expires on a day when the court is closed (e.g. court summer/winter vacation or public holiday), the suit, appeal or application may be instituted on the day the court reopens.

Section 5: Doctrine of Sufficient Cause (Collector Land Acquisition v. Katiji)

Section 5 does NOT apply to original suits. A debt-barred suit must be dismissed under Section 3. In Collector Land Acquisition v. Katiji (1987), the Supreme Court held that the judiciary should adopt a pragmatic approach and not pedantic when considering delay condonation in appeals.
