Frequently Asked Questions about Residential Rental Agreement Format

Why are rent agreements typically made for 11 months in India?

Under Section 17(1)(d) of the Registration Act 1908, leases of immovable property from year to year or for any term exceeding one year require mandatory registration with the Sub-Registrar. An 11-month agreement avoids the compulsory registration process and heavy registration charges while remaining legally binding on stamp paper.

Is police verification mandatory for tenants?

Yes, most municipal commissionerates and state police departments (such as Delhi, Mumbai, Bengaluru, Haryana, UP) make tenant verification mandatory under Section 188 IPC / Section 223 BNS. Failure by the landlord to verify tenant identity attracts penal liability.
