In civil cases character to prove conduct imputed, irrelevant

Full Text

In civil cases the fact that the character of any person concerned is such as to render probable or improbable any conduct imputed to him, is irrelevant, except in so far as such character appears from facts otherwise relevant.

Plain English Summary

In civil cases, a person's character cannot be used to prove that they likely behaved in a certain way, unless the character evidence is otherwise relevant.

Key Legal Elements

  • Character evidence in civil cases
  • To prove probability of imputed conduct
  • General rule: Irrelevant
  • Exception: Character appearing from other relevant facts

Practical Note

General character is irrelevant in civil suits because the focus is on specific facts of the dispute, not the person's general disposition.
