Production of documents or electronic records which another person, having possession, could refuse to produce
Full Text
No one shall be compelled to produce documents in his possession or electronic records under his control, which any other person would be entitled to refuse to produce if they were in his possession or control, unless such last-mentioned person consents to their production.
Plain English Summary
Protects a custodian of documents or electronic records from being compelled to produce them if the actual owner has a legal right to refuse production and does not consent.
Key Legal Elements
- Possession or control of documents or electronic records by a person.
- Another person is legally entitled to refuse production of those same materials if they held them.
- No compulsion to produce without the consent of that third party entitled to refuse.
Practical Note
This section protects legal privilege and confidentiality. If someone holds documents or electronic records on behalf of another person, and that other person has a legal right to refuse to produce them in court (for example, due to professional privilege), the custodian cannot be forced to produce them either, unless the privileged person gives consent. This prevents parties from circumventing privilege by targeting the custodian rather than the owner.
