Court not to alter judgment
Full Text
Save as otherwise provided by this Sanhita or by any other law for the time being in force, no Court, when it has signed its judgment or final order disposing of a case, shall alter or review the same except to correct a clerical or arithmetical error.
Plain English Summary
Strictly prohibits criminal courts from altering or reviewing a signed judgment, except for correcting clerical or mathematical mistakes.
Key Legal Elements
- Signed judgment is final
- No power of substantive review
- Exception for clerical/arithmetical errors only
- Subject to specific provisions of BNSS or other laws
Practical Note
Criminal courts do not have the power of substantive review. Once a judgment is signed, the court becomes 'functus officio'. Any substantial grievance must be addressed through appeal or revision in a higher court.
