Section 24Substantive

Offence requiring a particular intent or knowledge committed by one who is intoxicated

Full Text

24. Offence requiring a particular intent or knowledge committed by one who is intoxicated.

In cases where an act done is not an offence unless done with a particular knowledge or intent, a person who does the act in a state of intoxication shall be liable to be dealt with as if he had the same knowledge as he would have had if he had not been intoxicated, unless the thing which intoxicated him was administered to him without his knowledge or against his will.

Plain English Summary

This section presumes that a voluntarily intoxicated person possesses the same knowledge as a sober person for offences requiring specific intent or knowledge.

Key Legal Elements

  • Applies to offences requiring a specific knowledge or intent.
  • The offender commits the act in a state of voluntary intoxication.
  • Presumes the offender had the same knowledge as if sober, unless the intoxication was involuntary.

Practical Note

This replaces IPC Section 86. Note that while “knowledge” is presumed under this section, the court still must evaluate whether specific “intent” was present, although in practice they are closely linked.
