Section 166Procedural

Giving, as evidence, of document called for and produced on notice

Full Text

When a party calls for a document which he has given the other party notice to produce, and such document is produced and inspected by the party calling for its production, he is bound to give it as evidence if the party producing it requires him to do so.

Plain English Summary

If a party demands a document by notice, gets it, and inspects it, they must tender it as evidence if the producing party requires it.

Key Legal Elements

  • Binds a party who calls for a document under notice to produce it as evidence once they inspect it, provided the producing party demands it.
  • Prevents parties from fishing for documents, inspecting them privately, and then choosing not to tender them if unfavorable.
  • Maintains a balanced rule of fairness where inspection of requested documents carries the consequence of admissibility.

Practical Note

Warning for trial lawyers: Do not issue notices to produce documents lightly! If you give the other side a notice to produce a document, and they bring it, and you inspect it, they can force you to put that document into evidence, even if its contents damage your case. This is designed to prevent 'fishing expeditions' where a party inspects private papers of the opponent and then refuses to exhibit them because they don't support their case. Only inspect called-for documents if you are absolutely sure of their contents or are prepared to have them admitted.
