Birth during marriage, conclusive proof of legitimacy

Full Text

The fact that any person was born during the continuance of a valid marriage between his mother and any man, or within two hundred and eighty days after its dissolution, the mother remaining unmarried, shall be conclusive proof that he is the legitimate child of that man, unless it can be shown that the parties to the marriage had no access to each other at any time when he could have been begotten.

Plain English Summary

A child born during a valid marriage (or within 280 days of its end) is conclusively presumed legitimate. This can only be challenged by proving the parents had no physical access to each other.

Key Legal Elements

  • Birth during a valid marriage
  • Or within 280 days after dissolution (mother unmarried)
  • Conclusive proof of legitimacy
  • Rebuttable only by proof of 'non-access'

Practical Note

This is a 'Conclusive Proof' section. Courts are very strict about this; DNA tests are generally not allowed to override this presumption unless 'non-access' is first proven. The 280-day rule covers children born after a father's death or divorce.
