Section 391Procedural

Certain Judges and Magistrates not to try certain offences when committed before themselves

Full Text

Except as provided in sections 383, 384, 388 and 389, no Judge of a Criminal Court (other than a Judge of a High Court) or Magistrate shall try any person for any offence referred to in section 215, when such offence is committed before himself or in contempt of his authority, or is brought under his notice as such Judge or Magistrate in the course of a judicial proceeding.

Plain English Summary

Enforces the principle of natural justice by prohibiting judges and magistrates from trying offences committed against their own authority, except where summary powers are specifically granted by the Sanhita.

Key Legal Elements

  • Prohibition on trial of contempt by the same judge
  • Protection of natural justice principles
  • Exceptions for summary procedures (383-389)
  • Excludes High Court Judges from this prohibition

Practical Note

This section prevents bias by ensuring that a judge does not act as both the 'victim' of contempt and the 'judge' presiding over the full trial of that offence.
