Plain English Summary
Mandates the delivery of judgment within 30-45 days and requires a pre-sentencing hearing if the accused is convicted.
Key Legal Elements
- Judge gives judgment after arguments
- Timeline: Within 30 days of completion of arguments
- Extension: Up to 45 days with written reasons
- If convicted, Judge hears accused on sentence (pre-sentencing hearing)
- Sentence passed according to law
Practical Note
A critical procedural reform in BNSS is the strict timeline for judgments (30 to 45 days). This aims to reduce the long delays often seen between final arguments and the actual verdict. Sub-section (2) preserves the right of the convict to be heard on the quantum of punishment.
